JustRide Motorbike Adventures Co., Ltd. is a fully licensed and registered Tour Operator in adherence with the laws and regulations of the Kingdom of Cambodia. Hereafter in reference as JustRide.
Any and all disputes, claims, liables or any other such actions not settled through civil means with JustRide and their agents will be arbitrated by attorney and subject to the laws of the Kingdom of Cambodia.
The Customer is a willing participant who has chosen of their free will to purchase a JustRide tour product or service and by doing so submits to the Terms, Conditions and Acknowledgments herein. Hereafter in reference as the Participant.
Acknowledgment of Risk
The Participant acknowledges that riding a motorcycle of 400cc in Cambodia is a treacherous and life threatening activity, which can result in serious injury or death. The Participant acknowledges this wholy as their own personal risk and absolves JustRide and their agents of any and all liability therein. The Participant will willfully submit to signing a Release, Indemnity and Waiver of Liability to this effect. If at any point the Participant whilst engaged in riding a motorcycle feels uncomfortable or unable to proceed they must of their own free will stop the motorcycle in a safe area and get off the motorcycle. If the Participant is not willing to proceed they must verbally express this to their Tour Leader. JustRide reserves the right to remove any Participant from tour who is deemed unfit to ride and be subject to a cancellation fee(s) and or respective transaction fee(s).
The Participant will be over 18 years of age on the date of departure and hold a valid motorcycle driving licence, either national, international, partial (learner) or full. JustRide will require the participant to provide proof of said licence and it is to be carried on their person whilst on tour. The Participant will in good faith submit an accurate account of their motorcycle riding skills and experience.
JustRide reserve the right to refuse or cancel a booking at any time should the participant be deemed unfit to participate.
Should the Participant submit forged,fraudulent or invalid documents their booking will be null and void and subject to a cancellation fee(s) and or respective transaction fee(s).
The Participant will have valid travel insurance for the duration of their tour. The basic provisions should include Medical Insurance with repatriation to the participants home country and cover the specific risk of riding a 400cc motorcycle in Cambodia.
The Participant will consult with their insurance provider to confirm these basic provisions are covered. The Participant will produce a copy of their insurance policy highlighting said provisions and is to be supplied to JustRide with policy number, emergency number and next of kin number and any other such relevant information should it be required.
Should the participant fail to produce valid or sufficient proof of insurance, JustRide reserve the right to cancel the booking and subject to a cancellation fee(s) and or respective transaction fee(s). The Participant acknowledges that JustRide strongly recommend Casualty Evacuation Insurance for remote areas. JustRide provide bespoke short term Insurance solutions through their insurance partner Global Rescue. This is can be accessed through the JustRide website.
The Participant will in good faith disclose relevant details to JustRide to include, but not limited to; age, sex, nationality, allergies, innoculations, recent surgeries (12 months), recent injuries (6 months), viral infections (6 months), dietary requirements, disabilities, spasms, fits, tics, mental disabilities, chronic ailments, prescribed medications, hart conditions, vision impairment, respiratory impairment, photosensitivity and or any other such information that affects the wellbeing of the Participant and ability to operate a motorcycle. Any and all information supplied to JustRide will be treated with the strictest of confidence. JustRide reserve the right to cancel a booking should the Participant be deemed unfit to participate and be subject to a cancellation fee(s) and or respective transaction fee(s).
The Participant wholly accepts as their personal responsibility the following; driving licence, proof of insurance, personal insurance, medical insurance, evacuation insurance, next of kin contact information, air tickets (inbound & outbound), passport, visa(s), health certificates, personal safety equipment (helmet, jacket, gloves, pants, boots, eyewear) personal luggage (off the motorcycle), personal luggage (in storage),personal electronic equipment (camera, laptop, tablets, phone), personal medication, dietary supplements and any other such effects of a personal nature. JustRide waive any and all responsibility and liable for damages or loss of personal effects, be it by any means to include but not limited to; fire, theft, flood, cancellation, loss, handling in transit and storage.
The Participant accepts wholly the responsibility for the articles supplied to them by JustRide to participate in a tour, which include but not limited to ; motorcycle of 400cc (inclusive of accessories and attachments), hard case panniers and any other such articles owned and supplied by JustRide. Should any article supplied to the Participant be damaged, lost or broken, either directly or indirectly by a third party regardless of culpability the Participant will bare the cost of replacement, compensation and or repair.
Exclusive common wear articles as follows; brake pads, chain & sprocket, clutch cable, throttle cable(s), rotor disks and rubber hand grips. In such an event JustRide will document where possible and provide a written invoice for the participant to be paid in full by US Dollars cash before being released from tour. JustRide reserve the right to remove a participant from tour should they show blatant disregard for the articles entrusted in their care and be subject to a cancellation fee(s) and or respective transaction fee(s).
The Participant acknowledges that at anytime itineraries, routes and services are subject to change, changes include, but are not limited to the following; duration, distance, start time, finish time, route, roads, accommodation, meal choice and any other such variables affected by changes in weather, road conditions, mechanical failure, Force Majeure and third party suppliers.
JustRide will give notice of specific changes when and where possible. It is understood by the Participant that due to the adventurous nature of the activity this will not always be possible whilst on tour. In any such instance the Participant will in good faith follow the direction and decision of the Tour Leader.
The Participant will pay in full 100% at the time of booking. Payments can be made via credit card through the JustRide website.
In the event that the Participant requires a refund prior to departure, as follows:
60 days before departure: 100% refund
59 to 30 before departure: 70% refund
29 to 15 before departure: 50% refund
14 days or less: 0% refund
The Participant will be charged transaction fees for refunds and could take up to 25 days for final remittance.
JustRide product pricing is defined as inclusive to which includes the following; motorcycle rental, guide fees, fuel, accommodation based on single or twin share, entrance fees as stated, airport transfers by private vehicle (arrival & departure), 3 meals daily limited to one main menu (where available) item with one non alcoholic beverage per meal, VAT, Snacks & Drinks (non alcoholic) on tour.
The Participant acknowledges that the following articles are not inclusive in the pricing ; Bank fees, transaction fees, Visa fee, Air tickets, extra transfers, personal insurance, additional meals, alcoholic beverages, personal expense items and any other such items as not exclusively detailed in the inclusions.
The Participant acknowledges and accepts the following JustRide support vehicle policy:
3 Day Rides: unsupported
6 Day Rides: unsupported
7 Day Rides ++: mandatory support vehicle
All pillion rides: mandatory support vehicle
All custom/group rides: mandatory support vehicle
The Participant acknowledges that an unsupported trip is with the use of hard case panniers with limited carrying capacity and carrys specific risks and or limitations. JustRide will supply a support vehicle by request for trips under 7 Days in duration.
The Participant acknowledges that they are engaged in an adventurous activity in remote areas as such the carrying capacity is some instances will be limited.
The JustRide luggage policy is as follows:
3 Day Rides: 10kg max in Panniers, Excess secure in storage
6 Day Rides : 10kg max in Panniers, Excess secure in storage
7 Day Rides ++: 30kg++ Panniers & Luggage Transport
All pillion rides: 30kg++ Panniers & Luggage Transport
All custom/group rides: 30kg++ Panniers & Luggage Transport
JustRide will store excess luggage at their office under lock and key. The Participant accepts full responsibility for their personal belongings. JustRide waive any and all responsibility and liable for damages or loss of personal effects, be it by any means to include but not limited to; fire, theft, flood, cancellation, loss, handling in transit and storage.
The Participant acknowledges that JustRide strive to provide the best possible services where possible.
The Participant acknowledges that they are engaged in an adventurous activity in remote areas and as such services can be limited by third party suppliers and availability, services to include but not limited to the following; meals, accommodation, local transfers, admission and any other such articles supplied by a third party.
JustRide tours are escorted by competent and professional leaders. The Participant acknowledges that on tour the Tour Leaders decision on all matters is final and will respect his or her decision making to include but not limited to the following; start/finish time, route change, ride structure, trip duration, rest days, speed, break stops and any other such trip variable that affects the tour.
JustRide have a zero tolerance policy on drinking and driving. Under no circumstances will the Participant partake in alcohol and drive a motorcycle. This will result in immediate Trip Removal.
JustRide observe and enforce the following speed limits:
Cities & Towns : 40 Km/hr max
Country Roads/Trails: 65 Km/hr max
Secondary Roads: 75 Km/hr max
Open Road/Highway: 90 Km/hr max
Should the Participant engage in excessive speeding, dangerous driving or excessively revving of the motorcycle the Tour Leader will have the Participant removed from the trip and be subject to a cancellation fee(s) and or respective transaction fee(s).
The Participant acknowledges that they can be removed from a trip at anytime by the Tour Leader should it be deemed necessary to include but not limited to; inappropriate behaviour, reckless driving, drunkenness, use of narcotics, illness, injury, lack of ability, insufficient experience and any other such concern the Tour Leader might have such that the actions of the Participant are deemed unsafe or a danger to others. In the event a Participant should have to leave a trip JustRide will arrange a local transfer back to your departure point, the cost incurred by the Participant. Expect this to be up to 120 USD, allowing for remote locations.
Services provided by JustRide after departure will incur either a cancellation or rebooking fee subject to our suppliers discretion.
JustRide has a 0% refund policy for on trip departures. Please check your travel insurance covers such instances.
JustRide’s duty of care does not extend to participants that leave a trip voluntarily or they are asked to leave due to misconduct.
In exceptional cases where a participant has succumb to illness or has incurred an injury JustRide will follow up to insure the participants wellbeing and safe departure.
JustRide do not provide personal riding gear. It is acknowledged and understood by the Participant that this is for personal hygiene and safety reasons. The Participant will provide their own personal safety gear to include; helmet, jacket, gloves, pants, boots and protective eyewear. The Participant will at all times whilst driving a motorcycle wear personal safety gear imparticullary a helmet.
If at any point the Participant whilst engaged in riding a motorcycle feels uncomfortable or unable to proceed they must of their own free will stop the motorcycle in a safe area and get off the motorcycle. If the Participant at any time feels unsafe or unable to proceed they must verbally express this to their Tour Leader. JustRide reserves the right to remove any Participant from tour who is deemed unfit to ride and be subject to a cancellation fee(s) and or respective transaction fee(s).
